Based on the Law on Obligations (“Official Gazette of the SFRY”, Nos. 29/78, 39/85, 45/89 – decision of the CCY and 57/89, “Official Gazette of the FRY”, No. 31/93, “Official Gazette of SCG”, No. 1/2003 – Constitutional Charter and “Official Gazette of the RS”, No. 18/2020), the Consumer Protection Law (“Official Gazette of the RS”, Nos. 62/2014, 6/2016 – other law and 44/2018 – other law), and the Law on Personal Data Protection (“Official Gazette of the RS”, No. 87/2018), on July 1, 2020, Tehnika Hidraulike d.o.o. establishes the following
***GENERAL TERMS AND CONDITIONS***
INTRODUCTORY PROVISIONS
These Terms and Conditions apply to the relations between Tehnika Hidraulike and customers and service users.
These Terms and Conditions regulate the mutual rights and obligations of Tehnika Hidraulike and customers or service users in connection with the purchase of products from Tehnika Hidraulike and the use of Tehnika Hidraulike's services.
The application of the general terms and conditions is ensured by:
- Concluding a contract in the prescribed form between Tehnika Hidraulike and the customer/service user
- Any other form of business cooperation with Tehnika Hidraulike arising in accordance with applicable regulations without concluding a contract in the prescribed form
In the event of a conflict between the provisions of a concluded individual contract for a specific
sale or service and these General Terms and Conditions, the provisions of the individual contract apply primarily, followed by
the provisions of these General Terms and
Conditions, unless the individual contract for the specific sale and/or service itself specifies a different order of precedence.
The Terms and Conditions will be posted on the Tehnika Hidraulike notice board and on the website www.tehnikahidraulike.com no later than 15 (fifteen) days before they take effect.
ELECTRONIC COMMUNICATION
By accepting these terms and conditions, you agree to communicate with Tehnika Hidraulike electronically as well. Electronic communication means sending an e-mail message or visiting the website www.tehnikahidraulike.com. Clients may receive notices from Tehnika Hidraulike by e-mail or by publication on the website www.tehnikahidraulike.com .
When you visit our website www.tehnikahidraulike.com or send us an email message, you are communicating with us electronically. By accepting the terms and conditions, you consent to communicate with us electronically. Our communication to you will be by e-mail or by notices that we will publish on this website.

Only necessary, basic data about customers/service users and data necessary for business operations are collected, in accordance with good business practice and for the purpose of providing quality service. Clients/service users have the option to decide whether or not they want to be removed from the mailing lists used for marketing campaigns. All data on customers/service users is strictly protected and available only to employees who need that data to perform their work tasks and provide quality service. All employees of Tehnika Hidraulike d.o.o., including business partners, are responsible for respecting the principles of privacy protection.

All information available on the website is of an informational nature only and may not be used for commercial purposes or distributed to third parties. EXEMPTION FROM LIABILITY OF THE SELLER/SERVICE PROVIDER
The seller/service provider shall not be liable for non-performance of the contract and missed deadlines due to non-performance of contractual obligations by domestic and foreign suppliers.
The seller/service provider shall not be liable for non-performance of the contract and missed deadlines due to the failure of state authorities, agencies, and third parties to perform their obligations and tasks within a reasonable time on which the performance of the contract depends.
The seller/service provider shall not be liable for missed deadlines relating to, but not limited to, the issuance of certificates, attestations, decisions, confirmations, and other documentation necessary to finalize the service and fulfill the contract.
EFFECT OF CONTRACT TERMINATION
Upon termination of the contract, the contracting parties are released from their obligations, except for the obligation to compensate any damage.
If the customer terminates the contract before the deadline expires, the customer is obliged to reimburse Tehnika Hidraulike d.o.o. for the costs it incurred for the purpose of performing the contract.
EFFECT OF THE QUOTATION
The quotation applies exclusively to the work included in the quotation itself. If any mechanical damage and other defects are identified during the defect inspection and if additional work proves necessary, the client will be notified.
Further activities and any additional work will be presented to and agreed with the client, and a new quotation will be issued for that work.
CONFORMITY
All technical data, dimensions, drawings, weights, and other characteristics stated in quotations, Trailerwin drawings, brochures, and other documents received from Tehnika Hidraulike d.o.o. must be considered indicative, because they may be subject to changes and amendments by foreign partners as well as by Tehnika Hidraulike d.o.o., and as such may be changed at any time, even after a confirmed order and a concluded contract, without Tehnika Hidraulike d.o.o. being required to provide the customer with any written notice of these changes. The customer may not demand termination of the contract when the non-conformity is insignificant.
TRANSPORT
Tehnika Hidraulike d.o.o. is not liable for damage to or loss of products and parts if caused by the actions of a person authorized by Tehnika Hidraulike d.o.o. for transport, by the nature of the shipment, or by external causes that could not have been foreseen or eliminated.
At the customer's express written request, Tehnika Hidraulike d.o.o. may arrange insurance of the product and parts during transport.
From the moment of delivery of the products and parts, the customer is obliged to have at least the basic insurance required by applicable laws and regulations. Tehnika Hidraulike d.o.o. shall be considered exempt from any damage arising from negligent handling, maintenance, and use of the products and parts.
DELIVERY
In the absence of an agreement establishing otherwise, products and parts shall be deemed delivered on the day the customer is notified that they are ready and available at Tehnika Hidraulike d.o.o. From that day, the risks relating to the product pass to the customer, who is responsible for storage, safekeeping, maintenance, and all other actions that may affect the quality of the product. Delivery terms shall be considered indicative and non-binding. Tehnika Hidraulike d.o.o. bears no liability for delays in the delivery of products and parts caused by delays of foreign or domestic suppliers, force majeure, unforeseeable circumstances, or as a result of the actions of public authorities and third parties.
EXCLUSION OF THE EMPLOYER'S LIABILITY FOR WORKPLACE INJURY
The Employer shall not be liable for an Employee's workplace injury if the injury resulted from unusual and unforeseeable circumstances beyond the Employer's control.
The Employer shall also not be liable if a workplace injury resulted from extraordinary events whose consequences could not be avoided despite all efforts, such as earthquakes, floods, and other natural disasters.
EMPLOYER'S EXEMPTION FROM LIABILITY FOR DAMAGE CAUSED BY A HAZARDOUS ITEM
The Employer is released from liability for damage caused by a hazardous item where the damage arose solely as a result of an action by the Employee that the Employer could not have foreseen and whose consequences the Employer could not have avoided. The Employer is also released from liability where an employee violates the Employer's work procedures, i.e. fails to comply with workplace rules.
FAMILIARIZATION WITH SAFETY INSTRUCTIONS FOR VISITORS
Tehnika hidraulike d.o.o. attaches great importance to the safety of our visitors and employees. Visitors who enter and tour the work premises do so at their own risk. Visitors are personally liable for the costs of any property damage or personal injury caused by the visitors themselves. Please read the safety information carefully and follow the safety instructions. Every visitor is obliged to familiarize themselves with the safety instructions for visitors posted on the notice board. Tehnika hidraulike d.o.o. cannot be held liable for any injury if a visitor did not follow the stated instructions.
PRIVACY AND DATA PROTECTION NOTICE
The customer confirms that they have been informed of this in advance and expressly agrees, declares and authorizes the following:
- That all data provided, even orally, will be processed by Tehnika hidraulike d.o.o., our IT department, marketing department and other employees;
- That the above data may be transferred to companies and organizations whose involvement is necessary in the process of procurement, manufacture, transport, registration, delivery and other actions aimed at delivering the appropriate product and/or part
